These Terms of Service ("Terms") govern access to and use of Talencer AI Interview (the "Service"), a standalone AI-assisted candidate screening product operated by Talencer ("Talencer", "we", "us"). They apply separately from, and in addition to, the general Talencer Terms and Conditions that govern the recruiter marketplace. By creating an account, uploading a job description, inviting a candidate, or otherwise using the Service, you ("Client", "you") agree to be bound by these Terms. If you do not agree, do not use the Service. See also the Privacy Policy for this Service.

The Service lets a Client describe or upload a role, approve an AI-generated set of interview questions, and invite Candidates to complete a spoken interview at a link of their choosing. Each Candidate's recorded answers are transcribed and scored by an AI model against the approved questions, and the result is returned to the Client as a report.
The Service is a screening aid, not a hiring decision. Scores, transcripts and AI-written commentary reflect a structured reading of what a Candidate said in a limited-length interview. They do not verify a Candidate's identity beyond what the Candidate submits, do not constitute a background check, reference check, or right-to-work verification, and are not a representation that a Candidate is or is not suitable for a role. The Client is solely responsible for every hiring decision made using output from the Service, including any further verification the Client considers necessary before extending, and before finalising, an offer of employment.
You must be at least 18 years old and have authority to bind the organisation on whose behalf you register. You are responsible for the accuracy of your account details, for keeping your login credentials confidential, and for all activity carried out under your account. Notify us promptly of any suspected unauthorised use.

Interviews are recorded and transcribed, and a Candidate's voice, spoken answers, and any biographical detail they choose to give are processed to generate a transcript, a score, and a written report. This is personal data, and in some jurisdictions a voice recording may be treated as biometric or otherwise sensitive data subject to additional legal requirements.
As between Talencer and the Client, the Client is the data controller (or equivalent) for Candidate personal data collected through a role the Client created, and Talencer processes it on the Client's behalf and instructions to deliver the Service. The Client is responsible for having a lawful basis to invite each Candidate, for any notice a Candidate must be given before or at the start of a recorded interview, and for responding to a Candidate's requests to access, correct, or delete their data, which the Client may action through the dashboard or by contacting us.
Talencer will not use Candidate recordings, transcripts, or reports for any purpose beyond delivering, securing, and improving the Service (including detecting fraud, abuse, or answer substitution as described in the candidate-facing interview flow), and will not sell Candidate personal data. Recordings and reports are retained for as long as the Client's account or role remains active plus a reasonable period thereafter for legal, security, and dispute-resolution purposes, after which they are deleted or anonymised in the ordinary course, unless a longer period is required by law or requested by the Client in writing.
Interview questions, transcripts, scores, and written evidence in a report are generated in whole or in part by artificial intelligence and third-party speech-to-text and language models. AI-generated output can be incomplete, can mis-transcribe or misinterpret what a Candidate said, and can occasionally produce a score or comment that a careful human reviewer would not. Talencer does not warrant that any AI-generated output is accurate, complete, unbiased, or fit for any particular purpose, and the Client should treat every report as one input among several, reviewed by a person, before acting on it.
The Service is offered under plans with different role and invitation limits, as shown on your dashboard or the applicable pricing page at the time you subscribe or upgrade. Fees, where they apply, are quoted and charged in the currency and by the payment method shown at checkout, are exclusive of any applicable taxes unless stated otherwise, and, except where required by applicable law or expressly stated at the time of purchase, are non-refundable once a role has been created or an invitation sent, since AI generation and Candidate outreach are incurred immediately. Talencer may change its plans or fees prospectively, with notice to active Clients before the change takes effect on their account.
Talencer and its licensors own all right, title, and interest in the Service, including its software, AI models and prompts, question-generation and scoring logic, and branding. Nothing in these Terms transfers any of that to the Client. The Client retains ownership of the job descriptions and briefs they submit, and Talencer grants the Client a non-exclusive, non-transferable licence to use the interview reports generated from their own roles for their own internal recruitment purposes. The Client grants Talencer a licence to use submitted job descriptions and briefs solely to operate and improve the Service.
Each party will use the other's non-public information disclosed through the Service only to exercise its rights and perform its obligations under these Terms, and will protect it with at least the same degree of care it uses for its own confidential information of similar importance, but no less than reasonable care. This does not restrict either party's use of information that is or becomes public through no fault of that party, or that it lawfully already held or independently develops.
The Service relies on third-party AI, speech-to-text and speech-synthesis providers to generate questions, transcribe answers, and score interviews. Talencer selects these providers with care, but is not responsible for their downtime, errors, changes, or discontinuation, and will make reasonable efforts to maintain continuity of the Service if a provider becomes unavailable.
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Talencer does not warrant that the Service will be uninterrupted, error-free, or secure against all possible intrusion, or that any Candidate identified through it is who they claim to be.
To the maximum extent permitted by applicable law: (a) neither party will be liable to the other for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to these Terms or the Service, even if advised of the possibility of such damages; and (b) Talencer's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the total fees actually paid by the Client to Talencer for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by a party's negligence.
The Client will indemnify, defend, and hold harmless Talencer, its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) the Client's use of the Service in violation of Section 4; (b) the Client's hiring decisions or employment practices, including any claim by a Candidate alleging unlawful discrimination or an unlawful hiring practice; (c) the Client's failure to obtain any consent or give any notice required by law before inviting a Candidate; or (d) content the Client submits to the Service.
Talencer may suspend or terminate a Client's access to the Service, with or without notice, if the Client breaches these Terms, if required to comply with law, or to prevent harm to Candidates, other Clients, or the Service itself. A Client may stop using the Service, or close a role, at any time from the dashboard. Sections that by their nature should survive termination, including Sections 5, 8, 9, 11, 12, 13, and 16, will survive.
The Client represents that it is not, and is not owned or controlled by, a person or entity subject to UAE or other applicable trade sanctions, and will not use the Service to solicit or evaluate Candidates on behalf of any sanctioned party, or in a manner that would violate applicable export control or sanctions law.
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws principles. The courts of Dubai, United Arab Emirates, have exclusive jurisdiction to settle any such dispute, and each party submits to that jurisdiction.
Talencer may update these Terms from time to time to reflect changes to the Service or to applicable law. If a change is material, we will make reasonable efforts to notify active Clients (for example, by email or an in-app notice) before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
These Terms, together with the Talencer Privacy Policy, constitute the entire agreement between the Client and Talencer regarding the Service and supersede any prior agreement specific to it. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. A party's failure to enforce a provision is not a waiver of it. The Client may not assign these Terms without Talencer's prior written consent; Talencer may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its relevant assets.
